The Candid Lens — Terms of Service

These Terms of Service (“Agreement”) govern the relationship between The Candid Lens (“Photographer,” “we,” “us”) and you (“Client,” “you”). By booking us or paying the retainer, you agree to these terms.

1. DEFINITIONS

• Images: all photographic work created by the Photographer under this Agreement (prints, digital files, edited or unedited).

• License: permission granted to the Client to use the Images in specified ways.

• Session / Event: the photography service date(s) agreed between Photographer and Client.

2. OWNERSHIP & COPYRIGHT

• Photographer retains full copyright of all Images.

• Client is not purchasing the copyright but is granted a License for certain uses agreed in advance.

• Unless otherwise agreed, Photographer may use Images for self-promotion (website, social media, portfolio).

3. LICENSES & USAGE

• The License will specify what you can do with the Images (e.g. personal, commercial, print/web use).

• Any use beyond the agreed scope requires written permission and may incur additional fees.

• The License begins once full payment has been made, and the Images are delivered.

4. EDITING & ALTERATIONS

• Photographer will provide basic editing: exposure, contrast, colour correction, cropping.

• Any major retouching (removing or adding elements, artistic filters beyond normal editing) are not included unless agreed in writing & may cost extra.

• Client shall not alter Images in ways not permitted (filtering, cropping, adaptation) without Photographer’s consent.

5. PAYMENT TERMS

• A non-refundable retainer (deposit) is required to secure the date.

• Remaining balance is due before or on delivery of the final Images (or on a date agreed).

• Late payments may incur interest or fees.

6. CANCELLATIONS & RESCHEDULING

• If Client cancels, the retainer is forfeited.

• If rescheduled, subject to Photographer’s availability; may incur fees.

• If Photographer is unable to perform due to illness, accident, or circumstances beyond control, we will either reschedule or refund amounts paid. Liability will be limited to the amount paid.

7. LIMITATION OF LIABILITY

• Photographer will take all reasonable care, but is not liable for indirect loss, or for events outside their control (weather, equipment failure etc.).

• In any case, Photographer’s total liability will not exceed the total amount paid under this Agreement.

8. DELIVERY & ARCHIVING

• Photographer will deliver Images in a reasonable digital format (JPEG, PNG, etc.) and resolution agreed.

• Photographer may keep backup copies, but does not guarantee indefinite storage.

• Client is responsible for backing up and storing their own copies after delivery.

9. MODEL RELEASES AND PERMISSIONS

• If required, Client is responsible for obtaining model, location, property releases unless Photographer agrees in writing to handle these.

• Photographer gives no guarantee that any release provided will meet Client’s legal or licensing requirements beyond what is agreed.

10. ACCEPTANCE & GOVERNING LAW

• This Agreement, along with any agreed quote/invoice, constitutes the entire agreement.

• Any variation must be in writing between both parties.

• Governed by the laws of England & Wales (or your local jurisdiction).

• Disputes will be subject to appropriate courts in [your city/region].
